PUBLIC OFFER Service Agreement
1. General Provisions
This Public Offer sets out the terms and conditions under which the Service Provider (hereinafter referred to as the “Provider”) offers digital services to any individual or legal entity (hereinafter referred to as the “Client”).
By using the Provider’s website, submitting an order, making a payment, or taking any other action indicating acceptance of this Offer, the Client confirms their full and unconditional agreement with this Service Agreement.
Definitions
Agreement — this Public Offer form accepted by the Client.
Website — an online resource operated by the Provider where the Client can purchase services.
Services — digital products, including eSIM profiles and related connectivity solutions delivered remotely in electronic form.
Provider — the entity offering and delivering the Services.
Client — any person purchasing or using the Services of the Provider.
2. Subject of the Agreement
- The Provider delivers the selected Services, and the Client agrees to pay for them according to the prices displayed at the time of purchase.
- Services include the remote delivery of a digital eSIM profile and/or activation data (such as a QR code or activation parameters) for mobile connectivity in the selected country or region.
- All details of the Services, including features, limitations, activation methods, and usage rules, are described on the Website.
- The Service is deemed delivered once the eSIM profile (and/or activation data) has been sent to the contact details provided by the Client (email, messaging app, or other supported method).
- The Provider may involve third parties in service delivery while remaining responsible for the overall quality of the Services.
3. Rights and Obligations
3.1 Provider Responsibilities
- Ensure the Services are delivered as described on the Website.
- Provide customers with accurate information required for service activation and usage.
- Maintain confidentiality and secure handling of Client data.
- Inform Clients of any updates to the terms by publishing changes on the Website.
3.2 Client Responsibilities
- Provide accurate information when placing an order.
- Use the Services strictly according to the instructions provided.
- Not resell, duplicate, or distribute the Services without written permission.
- Check device compatibility before purchasing an eSIM (the Provider is not responsible for incompatible devices).
- Understand that once an eSIM profile has been installed or activated on the Client’s device, the Service is considered fully delivered and no refunds are provided, except as expressly stated in the Refund Policy or required by applicable law.
4. Payments and Pricing
- Prices for the Services are displayed on the Website and may vary based on region, plan, or mobile provider.
- All payments are processed through international payment systems available on the Website.
- The currency and applicable taxes or fees are shown on the checkout page before payment.
5. Refund Policy
A refund may be issued only if the Service has not been activated or used, and solely within the conditions described on the Website and in the Refund Policy.
Once an eSIM profile has been installed or activated on the Client’s device, the Service is deemed fully delivered and no refunds are provided, except where required by applicable law.
No refunds are provided in cases including, but not limited to:
- the Client’s device not supporting eSIM activation,
- incorrect installation or deletion of the eSIM by the Client,
- roaming restrictions imposed by mobile operators,
- network coverage issues in specific locations.
The Provider may request proof (screenshots, device info, or logs) to process a refund request.
6. Liability
- The Provider is not responsible for actions of mobile carriers, roaming restrictions, or network failures.
- The Provider is not liable for any damages resulting from improper installation, deletion, or misuse of the Services by the Client.
- The total liability of the Provider may not exceed the total amount paid by the Client for the Services.
7. Privacy
The Provider handles personal data in accordance with international privacy principles. Data is used exclusively for service delivery, support, analytics, and fraud prevention. Personal data may be shared with payment processors and telecom operators only to the extent necessary to provide the Services.
8. Changes to the Agreement
The Provider may update this Public Offer at any time. Updates become effective upon publication on the Website. By continuing to use the Services after such updates, the Client agrees to the updated terms.
9. Governing Law and Dispute Resolution
This Agreement is governed by the applicable laws of the jurisdiction where the Provider is registered, unless otherwise required by mandatory consumer protection rules.
Any disputes will be first attempted to be resolved through negotiations. If no agreement is reached, the dispute may be submitted to a competent court based on the Provider’s jurisdiction.
